Once you have made the important decision to sell your property, your conveyancer must commence with immediate tasks to have the Vendors Statement and Contract of Sale of Land documents prepared. Amongst the tasks required for these documents is to apply for an up-to-date title search, plan search, any instrument search if applicable, apply for all relevant statutory and government certificates from council, the water authority, planning & roads authorities and if applicable all required building permits.
After the Contract of Sale and Vendors Statement are completed and exchanged, the conveyancer should liaise with the mortgagee (if applicable) and if needed, prepare a Section 27 Statement seeking a release of deposit money. We engage and develop a good rapport with the mortgagee/mortgagors and selling agents to ensure a trouble free transaction.
Post contract, the conveyancer must continue to liaise with the selling agent, the purchaser’s representative, the mortgagee (if applicable) and attend to all their requirements including checking compliance with any contractual special conditions, following up the discharge of mortgage with the mortgagee and any encumbrance, obtaining an updated payout figure, obtaining the original Certificate of Title if unencumbered or transferring control of the electronic Certificate of Title; providing Foreign Residents Withholding Tax Clearance Certificate/s and GST Notification to ensure that no funds are withheld from the settlement monies, approving the Transfer of Land, preparing the required State Revenue Office Duties Form, checking and approving the Statement of Adjustments, advising of the required settlement payouts, attending settlement, and finally, ensuring that Notices of Dispositions are prepared and sent to the required authorities.
