What is Conveyancing?

Conveyancing is the area of property law that deals with legal and statutory processes required to effectuate the transfer of ownership of real estate from one person to another. This involves the preparation, execution, verification and lodgment of numerous legal documents.

Although it may appear to be straightforward, conveyancing practice can be quite complex. A diligent conveyancer has to consider all the issues such as the contract terms and conditions, mortgages, covenants, easements, caveats, the type of property title, the type of tenancy, local council regulations and zoning just to name a few.

There is a stipulated time-frame between the contract becoming binding and the contract being settled or completed; time is always of the essence. Within this time-frame, the vendor and purchaser have much to do. In summary, conveyancers undertake verification of identity, accuracy of title, property searches, advice on the effect of the contract, the preparation and certification of legal documents, calculation of rates and taxes, preparation of settlement statements, liaising with mortgagees and financiers (if applicable) and attendance of settlement.
